Ардчилсан нам толгойноосоо хөлөө хүртэл шинэчлэхээр болж, бүх шатанд дотоод сонгууль зарласан. Тодруулбал, шат, шатны Ардчилсан намын дарга, гишүүдийг тодруулах, мөн Үндэсний бодлогын хорооны гишүүдийг сонгох санал хураалт дөрөвдүгээр сарын 2-нд товлогдсон ч хойшилж болзошгүй нөхцөл үүслээ.

Учир нь Улсын Дээд Шүүх өнөөдөр /2017.03.15/ Ардчилсан намаас ирүүлсэн дүрэмд оруулсан нэмэлт, өөрчлөлтийг хэлэлцээд “Ардчилсан намын дүрэм нь Улс төрийн намын тухай хууль болон уг намын дүрэмд заасан шаардлагыг хангаагүй байна” гэж үзэн, хүсэлтийг нь хүлээн авахаас татгалзав.

Улс төрийн намын тухай хуулиар Үндэсний бодлогын хорооны гишүүдийг намын Их хурлаас сонгох ёстой аж. Гэтэл тус нам нэмэлт өөрчлөлт оруулсан дүрэмдээ Үндэсний бодлогын хорооны 389 гишүүнийг бүх гишүүдийнхээ саналаар тодруулахаар заасан нь уг хуулийн холбогдох заалтыг зөрчих үндэслэл болжээ.

Улс төрийн намын тухай хуулийн 13.3-т Намын их хурлын чөлөөт цагт намын бага, бүгд хурал, тэдгээртэй адилтгах намын төлөөллийн төв байгууллагыг намын их хурлаар сонгож байгуулна. Сонгуулийг нууц санал хураалтаар явуулна хэмээн заажээ.

Мөн Улс төрийн намын тухай хуулийн 5.1.3-т гишүүдээ намын удирдах байгууллагын төлөөлөлд орох, сонгуульд нэр дэвших, сонгогдоход хөрөнгө чинээ, эрхэлсэн ажил, албан тушаалаар ялгаварлахгүйгээр адил тэгш боломж олгох гэж заасан байна.

Хэд хоногийн өмнө тус намын гишүүн Ц.Оюунгэрэл хэвлэлийнхэнд мэдээлэл хийх үеэрээ “Улсын Дээд Шүүхэд Ардчилсан намын дүрмийг бүртгүүлээгүй, Үндэсний бодлогын хорооны гишүүд нь сонгогдоогүй байхад Дотоод сонгуулийн хороо дэнчин, хураамжийг тогтоосон нь Улс төрийн намын тухай хуулийн холбогдох заалтыг ноцтойгоор зөрчлөө” гэдгийг мэдэгдсэн удаатай.

Мөн тэрбээр Ардчилсан нам шинэчлэгдэх зорилт тавьсан юм бол дотоод сонгуулийг хуулийн хүрээнд нийцүүлэх. Хуульд нийцүүлэхэд цаг хугацаа шаардах тул ирэх дөрөвдүгээр сарын 2-нд зарласан дотоод сонгуулийн санал хураалтыг хойшлуулах ёстой гэсэн шаардлагыг намын дарга С.Эрдэнэд хаяглан хүргүүлсэн. Гэвч одоогоор Ардчилсан намын удирдлага дотоод сонгуулийн санал хураалтыг хойшлуулах эсэх шийдвэр гараагүй байгаа.

Харин энэ үед Улсын Дээд шүүх Ардчилсан намын дүрмийг бүртгэж авахаас татгалзсан нь “Хуульд нийцүүлж, дүрмээ дахин мэдүүл” гэдгийг тодотгосон хэрэг болов.

Нам шинэчлэгдэх эсэх нь дүрмээ хуульд нийцүүлж, дүрмийн хүрээнд үйл ажиллагаагаа явуулахаас эхэлнэ.

Гэвч Ардчилсан намын Хууль, дүрмийн бодлогын газрын дарга Б.Батхуяг Улсын Дээд Шүүхээс гаргасан шийдвэрийн талаар “Намын дүрмийг бүртгэх хурал хойшилсон. Нэмэлт материал гаргаж өгнө. Сонгуульд огт өөрчлөлт орохгүй” гэж намын гишүүддээ мэдэгджээ.

Эцсийн шийдвэрийг шүүх гаргадаг. Хэрвээ Ардчилсан намын шүүхийн шийдвэрийг үл хүндэтгэн, хууль зөрчин сонгуулиа зохион байгуулбал өөрсдөө л муухай харагдана.

Улсын Дээд Шүүхээс гаргасан шийдвэр, мөн Үндэсний бодлогын хорооныхоо өмнөөс шийдвэр гаргаж, сонгуульд өрсөлдөх дэнчин, хураамжийг тогтоосон Дотоод сонгуулийн хорооны шийдвэрийг хуульд нийцүүлж засах гаргалгаа нь юу байна вэ гэдгийг бид тус намын хуульч гишүүд болох УИХ-ын гишүүн асан Х.Тэмүүжин нараас тодруулсан юм. Дүрмийн нэмэлт, өөрчлөлтийг Улсын Дээд Шүүх бүртгэж аваагүй нөхцөлд хүчин төгөлдөр үйлчилж байгаа одоогийн хуучин дүрмээ мөрдөхөөс аргагүй аж. Энэ тохиолдолд Ардчилсан нам Их хурлаа зарлан хуралдуулах гарц л байна.

Өнөөдөр хүчин төгөлдөр үйлчилж байгаа Ардчилсан намын дүрмээр Үндэсний зөвлөлдөх хороо/нэмэлт өөрчлөлт оруулсан дүрмээр Үндэсний бодлогын хороо/ -нд өрсөлдөх татвар 1 сая төгрөг. Нийслэлийн Ардчилсан намын даргад өрсөлдөхөд дэнчин, хураамжгүй.

Харин Дотоод сонгуулийг зохион байгуулах хорооноос гаргасан шийдвэрээр Үндэсний бодлогын хороо/Хуучнаар Үндэсний зөвлөлдөх хороо/-нд өрсөлдөх дэнчин, хураамж нийт 6 сая төгрөг. Нийслэлийн Ардчилсан намын даргад өрсөлдөх бол 90 сая төгрөг гэх мэтчлэн тодорхой ханштай байгаа.

Дотоод сонгуульд өрсөлдөх нэр дэвшигчдийн бүртгэл өнөөдөр 00.00 цагаар дуусгавар болно. Гэвч дэнчин, хураамж төлж, шат, шатны сонгуульд өрсөлдөх бэлтгэлээ хангасан нэр дэвшигчдийн хувьд цаашдаа яах вэ гэдэг ойлгомжгүй болсон.

Өөрөөр хэлбэл, Ардчилсан намын дүрмийн нэмэлт, өөрчлөлтийн төсөл хүчин төгөлдөр үйлчлэх боломжгүй болсон нөхцөлд хуучин дүрмээ барих л гарц байна. Харин Ардчилсан намын удирдлага Их хурлаа хэзээ зарлах вэ?.
